Note: Since posting the editorial on November 9, 2011, EdPDLaw has received information that Caldwell was employed in Security at UMDNJ who entered him into PERS prior to his employment with Northern State Prison.  If so, it would appear that his account should not be "active" as listed by the Department of Treasury.  Unfortunately we have been unable to confirm this information.

HOW MANY PENSIONS ?

EdPDLaw has been investigating Pensions and Title Shifting within the Hudson County Department of Corrections.  Several discrepancies have come to light and there does not seem to be a reasonable explanation for them.

Most notable, the Department of Corrections employs Thaddeus Caldwell and has given him the title of Confidential Aide, a civilian position. However, the members of the Department refer to him as the "Director of Internal Affairs".   Caldwell is receiving a salary of $104,349 from Hudson County.

The Department of Treasury is reporting that Thaddeus Caldwell is currently collecting a pension from Northern State Prison from the Police & Fire Retirement Pension System (PFRS).  The Department of Treasury is also reporting that Thaddeus Caldwell is currently paying into PERS, the State Public Employees Retirement Pension System from an account with the University of Medicine & Dentistry.

EdPDLaw has confirmed with the Department of Treasury that this information is accurate.  However, the University of Medicine & Dentistry has no record of Caldwell in their employ.

The Pension Rules state:

RETURNING TO WORK IN A POSITION COVERED BY A DIFFERENT  RETIREMENT SYSTEM NEW JERSEY STATE-ADMINISTERED

If, as a “bona fide” retiree, you return to work covered by a different New Jersey State-administered retirement system, your PFRS retirement allowance may continue and you can receive salary from the employment; however, you cannot become a member of that retirement system (see “IRS Provisions” on page 1 about federal tax implications).

So, what is going on?  Who enrolled Caldwell in the UMDNJ PERS pension system?  No show job? Double, triple dipping?
